All properties managed by Luxury Beach Getaways

Terms and Conditions Applicable to all bookings

Subject to meeting any requirements set by Luxury Beach Getaways, you can make a booking enquiry on the Luxury Beach Getaways platform through the reservation system. All applicable fees, including listing fee, security bond, service fee, any applicable taxes (collectively, ‘Total Fees’) will be confirmed before booking a listing. You further agree to pay the total fees for any booking.

All properties listed on the Luxury Beach Getaways website are also listed on other management channels. We cannot guarantee the accuracy of the calendar. Your booking requests will be confirmed as soon as possible.

Receipt of a booking confirmation from Luxury Beach Getaways forms a legally binding agreement.

If you are the host, arranging a booking on behalf of additional guests, you are required to ensure that every other guest or visitor to the properties meets any requirements set by Luxury Beach Getaways, and are made aware of and agree to these Terms and Conditions, including all rules and restrictions outlined below.

Booking Accommodation

All properties are available for check-in no earlier than 3 pm on the day of arrival and must be vacated no later than 10 am on the date of check out unless agreed upon, in writing, before your stay.

Maximum Number of Guests

The number of guests allowed to occupy each property managed by Luxury Beach Getaways at any one time is outlined below:

– Liapari Beach House; maximum of nine (9) guests.

– Villa Kopai Luxury Beach House; maximum of nine (9) guests.

– Villa Provence; maximum of twelve (12) guests.

– Beachfront #12; maximum of twelve (12) guests

– Zaffiro Beach House; maximum of eight (8) guests.

– Hampton Beach House at Sapphire; maximum of ten (10) guests.

– Shambhala at Sapphire; maximum of ten (10) guests.

-Mont Sapphire Luxury Retreat (17 guests).

-Sapphire Coast Treehouse (8 guests)

-CC by the sea (10 guests).

Number of Guests

Number of Guests including visitors, should not exceed the number stated on the Confirmation Notice or subsequently agreed in writing or email.  Fees will apply for excess persons at the property AT ANY TIME not agreed with the owners in advance. Any undeclared persons at any time will be charged at $100/person/night

Check Out Time

Check out time is 10am unless otherwise agreed. A late departure will be charged at $300 per hour.

Cleaning

The total cleaning fee includes a standard clean. However, the property is to be left in a clean and tidy condition. Failure to do so will incur an additional charge to place the property back to its original state.

Should any additional cleaning be necessary, or the accommodation has had smoking inside, then any charges will be debited to your credit card. Any breakages, damages and excess cleaning items are to be paid for. Charges will be imposed if the accommodation is left in an unreasonable condition, eg:

– All rubbish is to be removed and placed in the bins provided

– Dirty dishes and unemptied dishwasher

– Rubbish not removed from the accommodation and disposed of in the outside bins

– Soiled or stained bed covers, doonas, rugs, upholstery etc.

– Lost or damaged remote controls

– Misplaced keys

– Extra charges apply to excessive handprints and or marks on walls/glass.

-Any Additional cleaning as a result of having a pet on premises

Damage

The renter assumes all liability for damage of home and contents within the term of their tenancy. Any breakages or damage to the accommodation, its fittings or facilities will be charged to the guest at replacement/repair cost plus 10%.

Events

Weddings, Functions, and Parties are strictly prohibited in all properties listed on Luxury Beach Getaways unless written consent is given approving the number of allowable guests. Any breach of this will mean immediate termination and eviction without refund.

Extra charges for security, cleaning, garbage removal, wear and tear, repairs to be a property will be required.

Noise and Behaviour

We love to see our guests enjoy themselves.  However, you are expected to behave in a respectful manner.  This is a residential area and we wish to create minimal impact to neighbouring properties.  We do not permit parties and the like, loud music, unlawful acts and general anti-social behaviour.  Violation of these requests will be addressed and your lease will be cancelled immediately without refund and alternate accommodation will have to be arranged

Disturbance to our neighbours, including excessive noise, is prohibited and may result in termination and eviction without refund. If a security company is called out to address the noise complaint, we will apply the call out fee from your security bond.

Law strictly prohibits bonfires and fireworks on beaches and properties managed by Luxury Beach Getaways.

Luxury Beach Getaways reserves the right to termination and eviction without refund.

Cancellation

When a cancellation occurs, the money paid is not refundable unless the house is re-let for the entire period for the same amount. A $200 re-booking fee will be applied against the refunded amount.

The owners of the property you have booked have the right to make alterations to any scheduled reservations within 14 business days of check-in date.

Security Bond

A Security bond is required prior to check in and may be used to cover incidental items such as (but not limited to): any breakages or damage incurred during your stay, or cleaning charges in excess of the normal level of cleaning. We process all credit cards prior to your arrival, the bond is released two days following your departure.

A Security Bond of $1000 applies to all bookings/Properties listed and managed by Luxury Beach Getaways (LBG) with exception to the below mentioned properties. Luxury Beach Getaways require the specified bond before arrival by credit card or a cash deposit into Luxury Beach Getaways account.

  • Sapphire coast Treehouse – Bond $500
  • Mont Sapphire Luxury Retreat – Bond $2000
  • All other LBG properties – Bond $1000

The Bond will be credited once the property has been inspected, and deemed to be in the same state as when you arrived.

Any damage, loss or theft determined by Luxury Beach Getaways as a result of any breaches of the Terms & Conditions will be applied against the bond.

The bond amount will be set aside by Monique Fitzgerald or HomeAway, for the period of your rental. Once the bond has been processed, we do not release, remove or lower the amount, until we determine if any charges are applicable as per the rental conditions.

Pets

Animals are not permitted without written consent before the check-in date. A Pet Levy applies to all bookings where pets are included. Any damage or additional cleaning as a result of the pet may incur additional charges.

Payment

To secure a booking a 50% deposit is required. We do not hold dates, reservations are confirmed upon receipt of the deposit. Acceptance of these Terms and Conditions is binding upon receipt of your payment.

The balance of the reservation amount must be received no later than 30 days before the booking date. Please ensure payments are made within the specified time limits or the booking will be cancelled and Luxury Beach Getaways has the right to attempt to re-let the property. If your deposit is paid by credit card then final payment will automatically be deducted from that same credit card 30 days before your check-in.

A 1% merchant surcharge applies to all Visa and MasterCard payments and 1.8% to all AMEX payments.

Liability

It is your responsibility to obtain suitable travel insurance to cover the booking costs in the event of unforeseen circumstances (for instance the cancellation of the booking). It is also your responsibility as the guest to ensure that the insurance purchased is adequate and appropriate for your particular needs.

Luxury Beach Getaways nor any other party involved in creating, producing, or delivering the Luxury Beach Getaways Platform, will be liable for any consequential damages, service, interruption, or system failure or any damages of personal or bodily injury or emotional distress arising out of the use of the Luxury Beach Getaways platform.

Feedback

Luxury Beach Getaways welcomes your feedback, comments and suggestions for improvements. You may submit feedback by emailing us, through the “Contact Us” section of the Luxury Beach Getaways website, or by other means of communication.

Any feedback about Luxury Beach Getaways will be considered non-confidential and non-proprietary to you. By submitting feedback to us, you grant us a non-exclusive, worldwide, royalty-free, non-binding, sub-licensable, continuous license to use and or publish your ideas and materials for any purpose, without compensation to you.

Luxury Beach Getaways is committed to providing exceptional service to our customers, so if you have a concern or disagreement, please contact us by email at monique@luxurybeachgetaways.com.au.

If you wish to make a dispute and or complaint about the Luxury Beach Getaways Terms and Conditions, we will examine the claim and endeavour to respond within 14 business days.

If we are not able to resolve your dispute about the Terms and Conditions, outlined above, within 60 days, you may seek relief through a third party and or other means.
